These Terms of Use ("Terms") govern your use of Kevin, a macOS application developed and published by PaperCloud Studios ("we", "us", "our"). By downloading, installing, or using Kevin, you agree to these Terms. If you do not agree, please do not use the application.
Subject to these Terms and your payment of the one-time purchase price, we grant you a non-exclusive, non-transferable, revocable licence to install and use Kevin on any Apple-branded device you own or control, solely for your personal and non-commercial use.
This licence is personal to you. You may not sublicense, rent, lease, sell, resell, or otherwise commercially exploit Kevin.
Kevin is sold for a one-time price of USD $1.99 (or the equivalent local currency). All payments, refunds, and billing are handled by Apple and are subject to Apple's Terms and Conditions. Refund requests should be submitted through the Mac App Store's standard refund flow.
You may not, and may not allow any third party to:
Kevin, including all visual design, character artwork, source code, and the "Kevin" name, is owned by PaperCloud Studios and protected by copyright and other intellectual property laws. These Terms do not grant you any right, title, or interest in the application or its contents other than the limited licence described above.
We may provide updates to Kevin from time to time. These updates may add, modify, or remove features. Your continued use of Kevin after an update constitutes acceptance of the updated application.
Kevin is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that Kevin will be uninterrupted, error-free, or secure, or that any defects will be corrected.
To the maximum extent permitted by applicable law, in no event shall PaperCloud Studios be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of or inability to use Kevin.
Our total liability for any claim arising from these Terms or your use of Kevin shall not exceed the amount you paid for the application.
You may terminate your use of Kevin at any time by uninstalling the application. We may terminate or suspend your licence if you materially breach these Terms. Upon termination, your right to use Kevin will cease and you must uninstall all copies.
These Terms are governed by the laws of Australia, without regard to its conflict of laws principles. Any dispute arising from these Terms shall be resolved in the courts located in Sydney, New South Wales, Australia.
We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date at the top of this page. Your continued use of Kevin after such changes constitutes acceptance of the updated Terms.
